–Simple Marijuana Possession. Utah Code 58-37-8(2)(D). Marijuana/Spice. Small amounts of marijuana or simple possession are charged as a Class B Misdemeanor. It carriers up to 6 months in jail and will suspend your driver’s license. A $690 fine is common.
–Drug Paraphernalia Possession. Utah Code 58-37A-5(1). Nearly anything qualifies for drug paraphernalia. Pens, spoons, carrying cases. Scales, baggies, joints, roaches or one-hitters, etc. Utah’s paraphernalia statute is written extremely broad to catch as much as the jury will convict on possible paraphernalia.

When you are cited for marijuana possession, paraphernalia possession or speeding you have 5 to 14 days to call the court and set a court hearing date. When you hire us, we do that for you. We call the court and set a pretrial conference date about 45 days out. We gather the police report and any body camera footage needed to defend your case, or 911 calls.
Warrants. If you blow off these drug charges, your driver’s license in your home state will eventually be suspended for non-appearance and a Utah warrant issued out of the Millard County Justice Court.
License Suspension—Home State Reciprocity. If you are convicted of a drug offense in Utah, most often your home state driver’s license will be suspended. If you have a Utah driver’s license, your Utah license will be suspended for 6 months if you were driving at the time of the offense.
Non-Resident Violator Compact. Utah is a member of the Non-Residence Violator Compact. Nearly every state is a member of the compact, except: Alaska, California, Michigan, Montana, Oregon, and Wisconsin.
Otherwise any criminal offense in Utah that you are convicted of that suspends you license, your home state will also suspend your license. Your home state that issued your driver’s license will grant reciprocity of Utah’s suspension action.
For most routine small drug possession cases, you don’t have the come back to Utah to attend court. The entire matter can be handled by mail, or nowadays, Webex video court. Unless you are asking for a jury trial or a complex evidentiary hearing, you will not be required to attend court in-person.
