TYPES OF UTAH EXPUNGEMENTS AS OF MAY 2022 (DOPL, DNA, CRIMINAL, JUVENILE ETC)

Utah ExpungementsUtah criminal expungements have been around for a very long time.  Yet there are other types of expungements that people can obtain under Utah law.

AS OF MAY 2022, HERE ARE ALL THE UTAH EXPUNGEMENT LAWS THAT I KNOW OF:

 

Utah Adult Criminal Convictions:  Utah Code 77-40a-101 et seq.

Utah is super generous on how many criminal convictions can be expunged.  In my Michigan law days, you could only get 1 expungement, ever.  In Utah, you just can’t have more than 5 criminal convictions and often simple drug possession crimes don’t count towards that tally.

There is no federal expungements outside of presidential pardons.Types of Utah Expungements

Utah Governor’s Pardon Power.   

When you don’t qualify for expungement you might be able to petition the Utah governor for a pardon.  Good luck.

 

Juvenile Expungements of Adjudications and Delinquency.   Utah Code 80-6-1004. 

Juvenile convictions are called adjudications. Adults are convicted.  You can expunge juvenile adjudications and other delinquency matters much easier than adult charges and convictions.

The normal waiting period for juvenile expungements is one year after probation ends and they are over 18 years old.  Certain violent crimes have a 5 year waiting period.

Non Judicial Adjustment Expungements.  Don’t forget to expunge juvenile non judicial adjustment files.  Non judicial adjustment are juvenile court actions short of regular juvenile delinquencies adjudications.

Utah Expungement of Protective Orders.  Utah Code 78B-7-1003.  Eff–05/2022

 New as of May 2022 you can now expunge certain expired or dismissed civil protective orders.  This does not apply to federal court protective orders, criminal or juvenile delinquency protective orders.  Purely civil protective orders, such as stalking, dating, cohabitant and child protective orders.

DOPL Expungements. 

Under Utah Code 63G-4-106(2) you can ask the Division of Professional Licensing (“DOPL”) to remove all publicly listed disciplinary information on their websites.  This is a much more limited expungement of public information.  The application fee is $200 and requires a 5 year waiting period or obtaining a criminal expungement of any underlying convictions.

DNA Expungements.  Utah Code 53-10-404.5.  

When you are charged with certain crimes or convicted, you are required to produce a DNA sample to the government.  Under limited circumstances of dismissal or failure to prosecute, you can get your DNA expunged from the Utah DNA registry.   See this article for more details:
