                How Long is the Waiting Period to Finish an Expungement Completely in Utah?

For a criminal conviction, once your statutory waiting period is over, the entire process takes 3-4 months.  Depending on how fast you return the application.

  1. Your Utah expungement lawyer determines your eligibility.
  2. You get fingerprinted at the your local police department.
  3. You fill out the expungement application.
  4. Once the expungement application is filed, it currently takes 3-4 months for the Utah Bureau of Criminal Identification to issue your eligibility certificate(s).
  5. Pay for Eligibility Certificates.
  6. File petition for expungement with appropriate sentencing court.  30 day waiting period for prosecutor to respond.
  7. File order of expungement. Another 10-14 days for the judge to sign the order.
  8. Mail certified copies of the expungement order on all effected agencies.
  9. Agency time to seal your records upon receipt of the certified order of expungements.

The entire process is around 3-4 months, depending on the court, the agencies and the BCI in turning around your application.
