Lehi City in Utah County has 79,978 people and growing. 
Nestled between Salt Lake and Utah County near the point of the mountain, the Lehi City Justice Court heard 5,835 misdemeanor cases in 2021. The judge is Morgan Cummins, the former prosecutor for Lehi City before taking the bench. Lehi City sprawls west and east of I-15 in Utah County with older sider on the west side and nearer growth on the east side.
In 2021 Lehi City prosecuted 126 DUIs. DUIs carry significant mandatory jail time and licensing sanctions. Here are the types of DUIs prosecuted in the Lehi City Justice Court.
DUI Section 502. The Classic DUI statute in Utah carries mandatory 2 days jail, unless you can convince the judge for community service. 120 days of licensing suspension, along with 12 months’ probation. See 41-6a-502 and 505(3)
Extreme DUI Section 502. If you blow .16 BAC or above, or have .05 BAC and illegal drugs in your system, you can be charged with an Extreme DUI. First offense Extreme DUIs carry 10 days mandatory jail. Second offense Extreme DUIs carry 20 days mandatory jail. See 41-6a-502 and 505(1).
Impaired Driving. No jail and no licensing sanction, but you can’t get an Impaired Driving if you have priors or blow .16 above, or a BAC of .05 and drugs in your system. See 41-6a-503.
Reckless Driving. Sometimes, sometimes, you can plead you DUI down to a Reckless Driving when there are serious evidentiary defects or suppression issues. Reckless Driving generally doesn’t suspend your license, unless you have priors within the last 12 months. See 41-6a-528. See 53-3-220 for two Reckless Drivings convictions in 12 month period, or combined with a prior DUI like conviction.
Metabolite/Drugged Driving. Drugged driving with illegal or prescription drugs in your system. Your license is suspended for 120 days on a first offense. No mandatory jail. 41-6a-17.
DUIs and domestic violence offenses are some of the most serious offenses charged in the Lehi City Justice Court.
The following crimes are tagged as domestic violence offenses, meaning they are generally enhanceable offenses and you can’t possess firearms if convicted:
(a) aggravated assault, (b) aggravated cruelty to an animalwith the intent to harass or threaten the other cohabitant; (c) assault, (d) criminal homicide, (e) harassment, (f) electronic communication harassment, (g) kidnapping, child kidnapping, or aggravated kidnapping, (h) mayhem, (i) sexual offenses, and sexual exploitation of a minor and aggravated sexual exploitation of a minor, (j)stalking, (k) unlawful detention or unlawful detention of a minor, (l) violation of a protective order or ex parte protective order, (m) any offense against property when a cohabitant is involved. (n) possession of a deadly weapon, (o) discharge of a firearm from a vehicle, near a highway, or in the direction of any person, building, or vehicle, (p) disorderly conduct, (q) child abuse, (r) threatening use of a dangerous weapon, (s) threatening violence, (t) tampering with a witness, (u) retaliation against a witness or victim, (v) unlawful distribution of an intimate image, (w)sexual battery, (x) voyeurism, (y) damage to or interruption of a communication device.
Crimes of domestic violence must involve a cohabitant—read girlfriend, lover, paramour or spouse and children. Otherwise the crime is not tagged a domestic violence crime.
One big problem with being convicted of a crime of domestic violence is being a firearms and dangerous weapons restricted persons. Meaning you can’t possess, trade, hold, sell, you name it, regarding firearms. See the primary gun restricted persons statute at 76-10-503. There are category I and category II Restricted Persons. Let’s not become one of them and hire a good attorney.
Police/Military Personnel. All police and military service members are immediately kicked out of the force when they are convicted of a domestic violence crimes. The stakes are high and you should hire an attorney who can win.
