Utah County local law enforcement agencies participate in DEA Metro Narcotics Task Force and the Utah County Major Crimes Task Force.
Meth. Meth convictions while operating a motor vehicle will suspend your driver’s license for 120 days. A meth first-time offense is a Class A Misdemeanor.
Heroin. A heroin first-time offense is a Class A Misdemeanor. Heroin, like Meth, and most illicit drugs will suspend your driver’s license for 120 days if you are operating a motor vehicle at the time of the offense.
Marijuana. Marijuana, as of 09/2020, is still illegal in Utah without a medical cannabis card. Street potency Marijuana is always illegal, regardless of whether you have a medical marijuana card. Marijuana is an enchanceable drug offense.
Drug Distribution/Selling. The amount of drugs found and whether you are accused of selling drugs will enhance most drug charges to felonies.
Drug Free Zones in Utah County. Most all drug charges are enhanced if you sell to minors or sell in, or around, drug-free zones. Drug-free zones under Utah law are defined broadly to be:
(1) Public Schools. In a public or private elementary or secondary school, or on the grounds of any of those schools during the hours of 6 a.m. through 10 p.m.;
(2) More School Grounds. In a public or private vocational school or postsecondary institution, or on the grounds of any of those schools or institutions during the hours of 6 a.m. through 10 p.m.;
(3) Daycares and Preschools. In or on the grounds of a preschool or child-care facility during the preschool’s or facility’s hours of operation;
(4) Public Parks. In a public park, amusement park, arcade, or recreation center when the public or amusement park, arcade, or recreation center is open to the public;
(5) Church Grounds. In or on the grounds of a house of worship as defined in Section 76-10-501;
(6) Library. In or on the grounds of a library when the library is open to the public;
(7) 100 Feet Around Drug Free Structures. Within an area that is within 100 feet of any structure, facility, or grounds included in Subsections (4)(a)(i), (ii), (iii), (iv), (v), and (vi);
(8) Around Kids. In the presence of a person younger than 18 years of age, regardless of where the act occurs; or
(9) Correctional Facilities. For the purpose of facilitating, arranging, or causing the transport, delivery, or distribution of a substance in violation of this section to an inmate or on the grounds of a correctional facility as defined in Section 76-8-311.3.

Being charged or convicted of domestic violence criminal charges will impair your right to bear arms. Often domestic violence charges bring temporary sentencing, or permeant protective orders. You can not possess a firearm if a valid protective order is entered against you. Under federal law, most domestic violence convictions render it illegal to possess firearms. Domestic violence assault convictions, or aggravated assault, make you a Category II Restricted Person under Utah law. See Utah Code Ann. 76-10-503(1)(b)(xi) (2020).
The law making you a Category II Restricted Person reads:
A person “ convicted of the commission or attempted commission of assault under Section 76-5-102 or aggravated assault under Section 76-5-103 against a current or former spouse, parent, guardian, individual with whom the restricted person shares a child in common, individual who is cohabitating or has cohabitated with the restricted person as a spouse, parent, or guardian, or against an individual similarly situated to a spouse, parent, or guardian of the restricted person.” See Utah Code Ann. 76-10-503(1)(b)(xi) (2020).
DUI. 120 days driver license suspension and two days in jail for the first offense and a $1,450 fine. You will be a Not-a-Drop Driver, meaning zero alcohol in your system while driving and you will have an interlock for 18 months.
Impaired Driving. A license suspension, or a reduced driving license suspension. This is an enhanceable conviction. No mandatory jail time is expected.
Metabolite Drugged Driving. If you have a controlled substance in your body when driving, outside of medical marijuana, you are deemed driving under the influence.
Reckless Driving. 3 or more moving violations in a 3-mile strip or reckless driving conduct constitutes the offense of Reckless Driving. Reckless Driving carries a $683 fine and a likely 12-month probation period, along with 80 points on your Utah driving record. Auto insurance rates are likely to go up.
Speed Racing/Contest. Speed racing first-time convictions will suspend your driver’s license for 30 days.
Traffic Tickets. 1-9 mph over is 35 points on your Utah driving record. 10-19 miles per hour over is a $240 fine and 50 points.
