What Utah Traffic Cases are Eligible for Expungement?

Most Utah traffic offenses are eligible for an expungement in Utah. Specifically the Utah Expunge Act defines traffic offenses as:

(i) Utah Traffic Code. An infraction, a class B misdemeanor offense, or a class C misdemeanor offense contained in the Utah Traffic Code. See Utah Code 41-6a-101. It has 20 chapters and is huge.
(ii) Utah Uniform Driver Act. An infraction, a class B misdemeanor offense, or a class C misdemeanor offense under the Utah Uniform Driver Act. 53-3-201. Common offenses are:
No Valid License; Motorcycle Permit Violation; Driving on Denied License; Allowing Unlicensed Person to Drive.
(iii) State Boating Act. An infraction, a class B misdemeanor offense, or a class C misdemeanor offense under the Utah State Boating Act. 73-18-101.
(iv) All local ordinances that are substantially similar to an offense listed above. Many cities have their own municipal code where they write traffic tickets from. These are equally expungeable.

It Has to Be A “Traffic Case Only” Expungement

You can’t expunged the traffic case if a non-traffic case is attached to it. To expunge your traffic matter in Utah the entire case must be a traffic only case.

DUI Speeding Example: You got a DUI (41-6a-502) and speeding (41-6a-601) violation on I-15 near Center Street, Provo, UT. You can’t expunge the DUI because you have a 10 year waiting period and you can’t expunge the speeding because the DUI is attached to the same case.

Driving without a License and Failure to Yield: You were cited on Orem State Street for driving on a denied license (53-3-227) and failure to yield to a blind person (41-6a-1007). You can expunge both traffic offenses because this was a true, pure traffic only case.
Speeding: You are busted speeding 21 miles per hour over on I-15 near Nephi, Juab County. Your common speeding under 41-6a-601 is expungeable after the appropriate waiting periods.

Utah Traffic Expungement Waiting Periods

You have wait the following time periods after your case closes successfully to expunge your Utah Traffic Code case.
3 Year Waiting Period: A Class C Misdemeanor or Infraction traffic case.
4 Year Waiting Period: A Class B Misdemeanor traffic case.

Common Bars to a Traffic Court Expungement
