There was a limited opportunity under 53-3-223(10) to get your license back pending the DUI court outcome. If you were convicted of a DUI subsequently, then you lost your license again without any opportunity to get a limited license or early reinstatement.

If you are arrested for a first or second offense DUI in Utah the Driver’s License Division (“DLD”) will suspend your license for 120 days or 2 years. Just like the old law, you may be eligible to reinstate your license early in accordance with UCA 53-3-223(10) by:
Step One: Contact a Hearing Officer
You call the driver’s license division and voluntarily become an interlock restricted driver. You must call the DLD and set a hearing with a Division hearing officer. It is still discretionary whether the hearing officer grants you a DUI limited license with your interlock. It is based on all the circumstances.
Step Two: Install an Ignition Interlock Device
Install an ignition interlock device on your car.
Step Three: Driver’s License Hearing
You need to show the Division hearing officer that you are capable of driving with an interlock and show mitigating circumstances on why you should get this limited DUI driving privilege.
Step Four: Pay Non Refundable Reinstatement Fees
You must pay your reinstatment fee and all clear all outstanding problems with your Utah license. Your license must be otherwise eligible for a license reinstatement but for the DUI. Your license must be eligible for reinstatement and nothing else can be holding it. No other prior drug charge or unpaid ticket can being holding on your reinstatement eligibility.
You will remain an ignition interlock-restricted driver for a period of 120 days from the original effective date of the suspension.
If you remove the ignition interlock device prior to the expiration date of the 120-day ignition interlock restriction period.

(1). Your license is suspended for some other reason.
(2). You are eligible for a Utah license because your out-of-state license is revoked.
(3). You didn’t install an interlock and provide proof.

Your license will suspended for the following 41-6a-502 DUI conviction. Just like the prior law, if you plead to a Utah Code 41-6a-502.5 Impaired Driving you get your license back after the minimal waiting period. See Utah Code 53-3-223(7)(b). (2). Become Interlock Restricted. You can get your license back early for a first and second DUI within a 10 year period if you voluntarily become an interlock restricted driver. See Utah Code 53-3-223(10).
