As of 07/2021 Tooele City is the most populous city in Tooele county, Utah. Tooele county has grown steadily with a 76,799 population in the 2020 census. Hiring someone who focuses on criminal defense can be really, really helpful. Avoid hiring an attorney who takes any type of law that walks in the door. A little divorce, bankruptcy, collections and then an occasional private criminal defense case will not help your cause.
DUI Defense. Have you been charged with a DUI on I-80? Aggressively challenging unconstitutional searches and seizures can make the difference in your Tooele, Utah DUI.
I-80 Reckless Driving. Just because you were going over 100 mph does not mean that you were driving recklessly under Utah’s Reckless Driving statute. Reckless Driving in Utah means you commit three or more moving violations in a two mile period, or where driving carelessly, recklessly or seriously endangering the public.
Ultimately it is up to the PEOPLE, the JURY, not the police officer or the judge to determine what is reckless under the law or just speeding. Going 120 miles per hour with on a straight stretch of Tooele County I-80 on a Sunday with no one around may not reckless driving, but going 120 in heavy I-15 traffic during rush hour could be reckless. Hiring a persuasive advocate can make the difference.
Tooele City Traffic Defense. Avoid your insurance rates going up with speeding convictions on I-80. Avoid state highway 138 traffic citations. Common traffic offense are no insurance, no driver’s license and speeding.
Fishing / Hunting DNR Crimes. Poaching has some serious mandatory minimum jail time and huge required criminal restitution attached to them. See these deeper articles on criminal restitution and Utah hunting crimes.
Domestic Violence. Domestic violence convictions will make you a restricted person and unable to have firearms. Domestic violence convictions carry up to 6 months in jail and are enhanceable offenses. Commonly disorderly conduction, criminal mischief, assault & battery and other crimes are charged as domestic violence crimes.
Disorderly Conduct. Public disorder type crimes tend to have defenses because what is considered disorderly to one juror may not disorderly to another juror. Ultimately it is the jury which will make the decision on what conduct constitutes disorderly conduct. Hiring a courtroom advocate who can go all the way to a jury trial is critical.
Simple Marijuana Possession. Marijuana laws are slowly changing in Utah and around the nation. Don’t let a simple marijuana possession charge ruin your clean criminal record. Get set up right for the immediate expungement. Don’t lose your driver’s license with a conviction.
Plea in Abeyances. Ensure you get a first time offender program when you have never had a criminal record before. See more about pleas in abeyances here. Plea in abeyances are basically Utah’s version of a first time offender program.
Expungements. Always CLEAR and SEAL your criminal record when you can. Expunging prior convictions, police reports, fingerprints or jail records is a huge benefit. 99 percent of the time you never show up in court and the entire matter is handled by mail.
