The Lehi City Justice Court prosecuted 5,835 misdemeanor cases in 2021. The judge is Morgan Cummins, the former prosecutor for Lehi City before taking the bench. DUIs are some of the more serious justice court case hear and carry mandatory license and jail terms. Well worth you time to get a serious defense.

Lehi City DUIs:

In 2021 Lehi City prosecuted 126 DUIs. Here are the types of DUIs prosecuted in the Lehi City Justice Court.

DUI Section 502. The Classic DUI statute in Utah carries mandatory 2 days jail, unless you can convince the judge for community service. 120 days of licensing suspension, along with 12 months’ probation. See 41-6a-502 and 505(3)

Extreme DUI Section 502 (New in 2021):

If you blow .16 BAC or above, or have .05 BAC and illegal drugs in your system, you can be charged with an Extreme DUI. First offense Extreme DUIs carry 10 days mandatory jail. Second offense Extreme DUIs carry 20 days mandatory jail. See 41-6a-502 and 505(1).

Impaired Driving. No jail and no licensing sanction, but you can’t get an Impaired Driving if you have priors or blow .16 above, or a BAC of .05 and drugs in your system. See 41-6a-503.

Reckless Driving. Sometimes, sometimes, you can plead you DUI down to a Reckless Driving when there are serious evidentiary defects or suppression issues. Reckless Driving generally doesn’t suspend your license, unless you have priors within the last 12 months. See 41-6a-528. See 53-3-220 for two Reckless Drivings convictions in 12 month period, or combined with a prior DUI like conviction.

Metabolite/Drugged Driving. Drugged driving with illegal or prescription drugs in your system. Your license is suspended for 120 days on a first offense. No mandatory jail. 41-6a-17.

Common DUI Penalties. See Utah Code 41-6a-505 for the Bulk of Mandatory Jail Terms:

1st Time DUI. First time DUI section 502 carry 2 days jail or community service, depending on what the judge orders. 120 days license suspension.

2nd Time DUI. Second offense DUIs are no longer prosecuted in Utah Justice Courts and are filed in the Utah District Courts. Not less than 10 days; or 5 days jails with 30 consecutive days of home confinement electronic monitoring and substance testing. 2 year license suspension.

1st Time Extreme DUI. First offense Extreme DUI at the higher BAC or combined BAC and drugs is not less than 5 days; or 2 days jails with 30 consecutive days of home confinement electronic monitoring and testing. 120 days license suspension.

2nd Time Extreme DUI. Second offense Extreme DUI at the higher BAC or combined BAC and drugs is not less than 20 days; or 10 days jails with 60 consecutive days of home confinement electronic monitoring and testing. 2 year license suspension.

Impaired Driving. No mandatory jail time, but up to 6 months max by statute. No license suspension outside of the initial suspension by the DLD that is reversed on the 59th day or when you enter your Impaired Driving plea.

Reckless Driving. No mandatory jail time. Generally no license suspension, unless you have a prior Reckless Driving or Impaired Driving in the last 12 months or the court specifically orders it. See 53-3-220.

Metabolite / Drugged Driving. No mandatory jail time. 120 day license suspension.

All DUIs and DUI Like Conviction. All Misdemeanor DUIs can carry up to 6 months in the county jail. Although unlikely that you will serve above and beyond the statutory mandatory minimums, if you hurt someone, hit something or otherwise have aggravating circumstances (like hitting the liquor store wall at 2AM) you can expect to serve some time above the mandatory minimums. A good DUI attorney will see this coming and help you avoid jail time above mandatory minimums.

               DUI Expungements. You can’t get a DUI expunged for 10 year after your case successfully closes. It is 10 years plus the probation period. Further you have to close your case successfully and pay all restitution and fines.

               DUI Sentence Reductions. Utah is extremely liberal in it’s expungement and reductions laws. If you successfully completed your DUI case you can ask the sentencing court to reduce your DUI one grade down or two grades down with prosecutor and court agreement. See Utah Code 76-3-402.

                      Example DUI 402 Reductions. You were convicted of a Felony DUI in 2018 out of Lehi City. You hire DUI Attorney Jake Gunter to file a 402 sentence reduction motion to reduce it from a Felony DUI to a Misdemeanor A DUI. A big difference because you are no longer a convicted felon.

                      Example DUI 402 Reductions. In 2010 you are convicted in the Lehi Justice Court of a Misdemeanor Impaired Driving. You hire DUI attorney Jake Gunter to reduce the DUI from a Misdemeanor B DUI to a Misdemeanor C DUI making your look better on employment and housing applications.

               DUI Interlocks. Every DUI like conviction that involved alcohol requires an interlock device. Interlock devices are attached to your car and require you to blow alcohol free or the car will not start. First DUI convictions have an 18 months interlock restricted driver. Second offense DUI have a 36 months as an interlock restricted driver. Failure to install, tamper or driving any motor vehicle without an interlock is a Class B Misdemeanor. See 41-6a-518 and 518.1.

                       No Alcohol Exception. If your DUI didn’t involve alcohol at all and the police report can prove it, you can your interlock DUI requirement removed. See Utah Code 41-6a-518.2

                       Work Truck Exception. There is a narrow, narrow and not automatic exception to driving work vehicles without an interlock. See 41-6a-518(1)(b).
Not A Drop Driver. Most every DUI like conviction, whether Impaired Driving or Metabolite / Drugged Driving will restrict you as a “Not A Drop” driver. Meaning you can’t drive with any alcohol in your system. The normal max per se .05 BAC doesn’t apply to you because you can’t drive with any alcohol.

               Drivers License Division Hearing Request. Remember that within 10 days of receiving a DUI arrest you MUST ask for a DLD hearing on whether the DLD should suspend or not suspend. Failure to ask for a DUI DLD hearing will automatically suspend your license.

               DUI Enhanceable Offenses. As you can tell above, all DUI convictions are enhanceable offenses. 2 within 10 years is 2nd offense. 3 DUIs within 10 years is a felony DUI. For enhancement purposes DUI convictions include all the classic types of DUIs regardless of how they pled own. Impaired Driving, Metabolite, DUIs, 2nd Offense DUIs and even out-of-state DUIs.

With enhanced DUIs, your jail time, license suspension terms, interlock times and alcohol restricted driver and all go up.
