Types of Juvenile Expungements in Utah

Clearing your juvenile record is essential for ensuring a brighter future. Here’s a breakdown of juvenile criminal actions and their eligibility for expungement under Utah law.

  1. Criminal Investigations or Dismissed Cases

If you were investigated but never faced juvenile court or probation, these records are eligible for expungement.
Waiting Period: Immediately eligible if:

  • No formal adjudications or non-judicial adjustments exist.
  • No pending delinquency or criminal cases.
  1. Juvenile Delinquencies (Adjudications)

Juvenile crimes result in adjudications rather than adult convictions. If a judge adjudicated your case, you can expunge it under specific conditions.
Waiting Period: Eligibility requires:

  • 1 year since court jurisdiction ended or release from custody.
  • No pending criminal/delinquency cases.
  • No violent felony convictions in 5 years (Utah Code 76-3-203.5).
  • Payment of all restitution.
  • The offense was not murder or aggravated murder.

  1. Non-Judicial Adjustments

Most minor juvenile offenses are handled by probation officers without formal court proceedings. These are typically eligible for automatic expungement.

Exceptions: The following offenses are not automatically expunged:

  • DUI
  • Reckless endangerment
  • Negligent homicide
  • Sexual battery
  • Possession of dangerous weapons (especially on school premises).

Why Should You Expunge Utah Juvenile Records?

Expunging juvenile records can:

  • Protect your privacy and future opportunities.
  • Improve eligibility for jobs, housing, and financial applications.
  • Support career goals in the military, law enforcement, or roles requiring security clearance.
