Common Herriman Justice Court Criminal Cases:

De Novo Review Of Justice Court Cases (Appeals)

Because Utah Justice Courts are still considered “Not a Court of Record” you automatically get a full De Novo Appeal. Nowadays all justice courts are recorded, but back in the day these courts often were not recorded and many of the justice of the peace were not attorneys. As a result Utah traditionally gives a full De Novo appeal to justice court cases. De Novo is stupid word for “Do Over.” If you lose in the Herriman Justice Court you can appeal and do it all over again with a De Novo Appeal. The appeal will be heard by a sitting Utah District Court judge in Salt Lake County. A De Novo justice court appeal is not a cold appeal on the trial court record, but another live jury trial. Expungements and 402 Sentence Reductions

Part of any justice court plea bargain is the defendant’s ability to file 402 sentence reduction motions or file for an expungement at the appropriate time.

An expungement completely seals all government documents from the public eye. The police and prosecutor’s can still see them, but prospective employers, landlords or lenders can’t see them.

Expungement Waiting Periods.

The waiting period for a Class B expungement is: 4 years after probation ends successfully.
The waiting period for a Class C expungement is: 3 years after the probation ends successfully.

You can reduce the expungement waiting periods by filing a 402 sentence reduction motion and reducing your conviction from a Class B to a Class C, eliminating one year of the waiting period.
